The Turkish Patent & Trademark Office (TURKPATENT) has published its draft regulations on the implementation of the new Industrial Property Law on 4 January 2017. The public review and comment period has started and comments can be submitted via e-mail to email@example.com by 9 January 2017 (EOB).
The new industrial property law no. 6769 replaces the present decree-laws for the protection of patents, trademarks, designs, geographical indications and integrated circuit designs. It addresses some important areas of daily legal practice such as, for example, requirements for a notarized letter of consent from the earlier right holder to overcome ex officio refusals, procedures and principles during the opposition and negotiation proceedings for trademarks as well as conditions for depositing biological materials, search and examination stages, post grant opposition proceedings, re-institution of lost rights, employee/university inventions and an updated utility model system for patents.
